How Many States Have Casinos?

Sports betting was previously prohibited under federal law by the now-defunct Professional and Amateur Sports Protection Act (PASPA) until early 2018. The only exception to this prohibition was Nevada, which had the ability to offer intrastate sports betting. However, Delaware, Oregon, and Montana also had limited exemptions. This can be seen in section 3701 et seq (PASPA) of the United States Code. Currently, there are 15 jurisdictions, in addition to Nevada, that have either authorized or begun sports betting. These jurisdictions include Arkansas, Delaware, Illinois, Indiana, Iowa, Mississippi, Montana, New Jersey, New Mexico, New York, Pennsylvania, Rhode Island, Tennessee, West Virginia, and the District of Columbia. It is interesting to note that the Pueblo tribe of Santa Ana in New Mexico was able to offer sports betting at their casino property without requiring state legislation. Out of these jurisdictions, all but five (Arkansas, Mississippi, New Mexico, New York, and Rhode Island) permit mobile or online sports betting. Notably, Tennessee's law exclusively allows for mobile betting and does not have a land-based or retail component.
